A written policy is required. A template is not legal advice.

49 CFR 382.601 says the employer provides educational materials and a policy. SJCC can sell a written policy when that document is actually ready. The price is $49. It is not charged today, and it is not a law firm’s opinion.

Drivers have to be told the basics: who the person to contact is, what conduct is prohibited, what happens after a positive or a refusal, and how testing works. The materials are the employer’s to hand out and the driver’s to receive. A PDF in a shared drive that nobody opened is a weak file.

Membership does not currently include a custom policy. When the product is live, it will be a standard document you adopt, not a brief written for your last audit.

Are you my lawyer if I buy it?+

No. The agreement already says SJCC is not a law firm. A policy template does not change that.

Do non-DOT staffing firms need a Part 382 policy?+

They need a workplace policy if they test. They do not need the FMCSA policy unless they employ people in safety-sensitive driving jobs.
